Florida Statutes, Chapter 400, specifically provides for the development, establishment and enforcement of basic standards for the health, care and treatment of persons in nursing homes and related health care facilities. In addition, federal civil rights law mandates equal access in all nursing homes regardless of race, color or national origin.

Unfortunately, nursing home abuse and patient neglect is a real problem. In most cases, a lawsuit is filed to protect the rights of nursing home residents and to obtain compensation for the physical and/or metal pain and suffering or wrongful death. Legal action is generally brought on by the resident, legal guardian, or by the estate of a deceased resident.

A few signs and symptoms of nursing home abuse and neglect include:

• Bed sores
• Dehydration
• Falls
• Fractures
• Improper medication
• Poor or inadequate staffing
• Rapid weight loss or gain
• Renal failure
• Signs of malnutrition
• Unexpected death
• Unexplained injuries
• Unsanitary conditions
• Visible bruises
